Tiles outside maxextent should not be requested

Description

Tiles outside maxextent should not be requested when a layer is not a baseLayer. For baselayers, that background color matters -- if a layer is not a baselayer, then requesting it makes no sense. (I have a patch for this -- the issue is at this point idealogical, rather than one of code.)
